초록
최근 기록물 전자화․정보화로 기록물 이용 및 방식이 달라지면서 공공기관이 보유하고 있는 기록물의 저작권에 대한 관심이 높아졌다. 이글은 공공기록물의 저작물성과 저작권 보호를 살펴보기 위해 법적 및 내외 국립기록보존소 소장기록물의 저작권 및 이용사례 등을 검토하였다. 그 결과 우리나라는 공공기관생산 기록물 대부분이 업무상저작물로 보호받고 있으며, 국가기록원 소장 기록물도 사상과 감정이 표현된 독창적인 것은 저작물로 인정받을수 있고, 저작권자는 대부분 국가(중앙정부)와 지방행정기관 등 기록물을 생산한 곳이라고 결론지었다. 공공기록물의 이용활성화를 위해서는 정부저작물의 만인의 공유화에 대한 재고, ꡔ저작권법ꡕ과 ꡔ공공기록물관리법ꡕ, ꡔ정보공개법ꡕ 등에 대한 수정보완, 공공저작물 총괄기구 설치 및 지침 마련 등 공공저작물의 공정이용 체계 구축이 필요함을 제시하였다.
Abstract
In the midst of computerization and digitization of the archives, the way of use and the need of users to use the public archives has been changed and expanded. It draws concerned party's attention to the copyrights in the public archives and the protection of the copyrights of the public archives. This study examines the exiting copyright laws in Korea and some foreign countries, interprets the laws, and presents legal implications when the laws are applied to the public archives held in the National Archives of Korea(NAK). The public records are “literary works" and their copyrights are to be protected. Most of the public archives held in the NAK are also “creative works" which are the presentations of thoughts and feelings of the individuals, the records creators in the public agencies. The holder of the copyrights of the archives is not the NAK, but the agency which created the archives, such as the central government and local governments. To promote the use of public archives, we need to expand the public domain in the public records and archives and the fair use of the archives. To do this, I suggest to amend and complement the Copyrights Act, the Pubic Records/Archives Management Act, and the Opening Records in the Public Agencies Act(FOIA in Korea). The establishment of a coordinating body dealing the copyrights in pubic record and archives is strongly recommended. The coordinating body will provide guidelines on protecting copyrights and expand the fair use and the public domain of the public archives.
초록
이 연구의 주요한 목적은 2015년부터 진행될 본격적인 전자기록 이관과 관련하여 영구기록물관리기관과 기록관이 어떤 활동을 진행하고 있는지를 드러내기 위한 것이다. 이관방법론 표준에 근거하여 공공 전자기록 이관과 관련하여 중요하게 확인해야 하는 활동 영역을 도출하고 2014년 현재 시점에서의 이관 현황을 돌아보았다. 이 과정을 통해 2015년으로 예정된 본격적인 전자기록 이관에 있어 주요하게 문제가 발생할 것으로 예상되는 지점을 확인하고, 향후 안정적인 공공 전자기록 이관을 준비하기 위해 충분히 논의되어야 할 문제들을 가시화하고 공론의 장을 마련하는 기초를 마련하고자 하였다.
Abstract
This study aims to expose the current status of the transfer of public digital records. Based on the PAIMAS transfer methodology, it identified the domains of transfer in the Korean public sector. Through the result of the interviews with experts in the field, this study examined what the records centers and the National Archive of Korea had prepared using the domains. Through the examination, the expected problems and subject to be discussed were thus presented, which are expected to provide a forum for further discussions.

소셜미디어는 개인적 영역과 공적인 영역에서 다양하게 활용되고 있으며 시대의 문화와 역사를 증거하는 기록으로서의 가치를 지니고 있다. 최근 소셜미디어가 국내외 기관의 정보서비스 영역과 공적인 커뮤니케이션 통로로 활용되고 있고 소셜미디어 기록물의 획득 및 아카이브 사례들이 발표되고 있다. 본 연구는 소셜미디어가 가지는 가치를 조명하고 해외 기관의 아카이브 사례를 분석한 후 중앙행정기관의 기록관리 사각지대에 있는 소셜미디어 기록을 획득하여 아카이브는 방안을 제시하였다.
Abstract
Social media is utilized in both personal and public domains in various ways, with a value on being the recorded evidence of modern day’s culture and history. Recently, social media is being utilized very actively—domestically and abroad—as an organization’s information service domain and as a public communication pipeline. Also, there are case studies released regarding the capturing and archiving of social media records. This research highlights the value that social media has, with an, objective of presenting the implementation of an archival method that captures the social media records in the blind spot of the Central Administrative Organization’s Record Management.
