초록
본 연구는 대통령기록을 둘러싼 현재 진행형의 문제들에 대한 제도적 대안을 모색하는 데 목적이 있다. 이를 위해 본 연구는 대통령기록 관련 법령의 연혁을 살펴보고, 대통령지정기록제도를 중심으로 한 대통령기록의 보호와 공개에 관한 이슈들을 논의하고자 한다. 2013년 4월 입법 발의된 「대통령기록물 관리에 관한 법률」(일부개정법률안)의 의의와 문제에 대한 비판적 분석을 바탕으로, 대통령기록을 둘러싼 대통령기록의 범주, 관리주체, 지정대리인, 생산 관리 등 4가지 쟁점을 논의하고, 대통령기록의 보호와 공개에 대한 정책적 대안을 제시한다. 대통령기록관리기관의 독립성 보장을 위해 대통령기록관리기관의 전문성 및 중립성 확보, 위상과 기능 회복 및 강화, 대통령기록관리 책임 주체의 임기와 신분 보장이 요구되며, 대통령기록관리의 혁신을 위해 생산 관리의 강화와 보호 및 공개의 강화가 시급함을 주장한다.
Abstract
The study aims at providing alternative strategies for ongoing issues concerning presidential records. It reviews a history of legislation about presidential records management and discusses issues on protection and disclosure of access-restricted presidential records. Four major issues—presidential records’ category, management authority, designated representative, and production control—are argued. As a result, this study proposes solutions to guarantee the independence of presidential records management agency and to innovate a presidential records management process.

본 논문은 2007년 4월부터 시행되고 있는 현행 기록물관리법의 개정 방향과 의의를 분석하고, 개선 방안을 제시한다. 우리의 기록물관리제도는 1999년 기록물관리법의 제정을 시점으로 지난 몇 년간 괄목할 만한 외양적 성장을 이루었다. 하지만 우리의 기록관리 법제도는 기록의 생산, 관리, 공개, 이용 등 기록물 관리 전반에 걸친 적잖은 문제점들을 노정하고 있다. 이에 본 논문은 기록물관리체계, 기록물 공개열람 정책, 전자기록물체계를 중심으로 기록물관리법의 개정 내용을 살피고, 국가기록원의 위상 및 기록물공개의 기준예외규정 등과 관련된 문제들을 비판적으로 분석한다. 이와 함께 현행 기록물관리법에 미비한 웹 기반 기록물의 수집과 보존에 관한 문제를 다룬다. 이러한 논의를 바탕으로 국가기록원의 법제도적 위상 제고, 기록물 비공개분류 기준절차예외 규정에 대한 개선 방안을 논의한다.
Abstract
This article reviews the current Public Records Management Act which revised in October 2006 and put in force in April 2007. Since Public Records Management Act has been enacted in 1999, the external development of record management is significant. The Road Map for Record Management Reform in 2005 and the Information Strategy Project in 2006 are prime examples. However, our legal system concerning record management is still posing a number of problems, ranging from issues about objects and definitions of record management to issues of access. These issues have been subject to serious critics from various stakeholders, including civil organizations and academics. The article analyses a legal status of the National Archives of Korea and issues concerning access to current and archival records. As a result of the discussion, the article provides alternative plans.
